March 24, 2000 Case No. 90-2908-GD-3Probate DivisionOrder on Petitioner's Emergency Petition For: An Order Prohibiting or restraining Visitation of the Ward; An ORDER Restraining Violations of the Ward's Privacy; An ORDER Authorizing the Hiring of a Security Guard; AND ORDER Restraining Interference or Tampering with Witnesses; AND, an ORDER Authorizing the Transcription of the Testimony of Father Gerard Murphy; AND Upon Respondent's Petition for Extension of Time of Stay THIS CAUSE having come on to be heard upon Petitioner's Emergency Petition For: An Order Prohibiting or restraining Visitation of the Ward; An Order Restraining Violations of the Ward's Privacy; An Order Authorizing the Hiring of a Security Guard; And Order Restraining Interference or Tampering with Witnesses; and, an Order Authorizing the Transcription of the Testimony of Father Gerard Murphy; and Upon Respondent's Petition for Extension of Time of Stay, and the parties and their respective counsel having reached an agreement in open Court, and this Court being fully advised in the premises, it is therefore ORDERED AND ADJUDGED as follows: 1. As to visitation with Theresa Schiavo, any persons related by blood or marriage to the Ward are permitted to visit the Ward at Palm Garden of Largo Nursing Home at any time. Any persons on the stipulated visitor's list are permitted to visit the Ward at Palm Garden of Largo Nursing Home if accompanied by a relative of the Ward. However, no visitation shall ever consist of more than six persons at any given time. These terms shall remain in effect until and unless modified in writing by the Court or by stipulation of the parties. 2. The Respondents, Robert Schindler, Jr., and Suzanne Carr, are prohibited from photographing, taking videos, or taking any other like pictorial representations of the Ward, or causing same to be taken by other persons, without prior approval of this Court. The Respondents Robert Schindler,Jr., and Suzanne Carr are further prohibited from causing the Ward to be examined by any physician without prior approval of this Court. The parties have the right to seek Court modification of these terms in the future should they desire to do so. 3. The Petitioner is hereby granted the authority to hire a security guard for the protection of the Ward in a time and manner of his discretion, so long as the security guard in no way hinders or interferes with visitation between the persons set forth in Paragraph 1 above and Theresa Schiavo. The Petitioner is also granted the authority to hire a security guard for his own person, should he choose to do so. The costs associated with hiring security personnel as set forth herein shall be borne by the Guardianship of Theresa Schiavo. 4. The Respondents' Petition for Extension of Time of Stay is hereby granted [marked through and itinialed by George W. Greer] This Court's Order of February 11, 2000, is hereby stayed until thirty (30) days beyond the exhaustion of all appellate remedies herein, without prejudice for the Petitioner to lift the Stay.
